Mrs. Akindele is dead — Family mourn as death hits Actress Funke Akindele.

Funke Akindele, Peoples Democratic Party, PDP, deputy governorship candidate in Lagos State, has lost her mother.

The Nollywood actress’ sister, Olubunmi Akindele, made the announcement on Tuesday.

Although she did not reveal what led to her death, Olubunmi stated that their mother died on Tuesday.

“It is with heavy hearts, but in total submission to God Almighty that the Adebanjo and Akindele families announce the passing of their daughter, mother, grandmother and sister, DR. R B Adebanjo-Akindele, which occurred on Tuesday 07 February 2023.”



She prayed that her gentle soul rest in eternal peace.

”Obsequies in honour of her passing shall be announced in due course-Olubunmi Akindele.”

Alleged rally attacks: I’ll not be intimidated – Jandor vows.

The Governorship Candidate of the Peoples Democratic Party, PDP, in Lagos State, Dr Olajide Adediran, popularly called “Jandor” has expressed concern over alleged series of attacks on his team by suspected ruling All Progressives Congress, APC hoodlums during campaign tours in various parts of Lagos, saying he would not be intimidated despite the acts.

Jandor, however, called on President Muhamnadu Buhari and Inspector General of Police, IGP, Usman Akali Baba to live up to expectations and ensure a crisis-free campaign in the state.

He made the remarks at a world press conference over the continued attacks on the campaign team, yesterday, held in Alausa, Ikeja, and Lagos.

Jandor, however, vowed to continue with his ward-to-ward campaign ahead of the 2023 general elections without succumbing to any form of intimidation, threat and harassment, saying that Lagos must experience a breath of fresh air in 2023.

The conference was attended by the party chieftains, led by chairman, Phillip Aivodje. Others included market women who were victims of recent attacks, carried out by thugs.

Jandor, who made the call against the backdrop of a series of attacks on his campaign train and his deputy, Ms Funke Akindele, in recent times, since he flagged off his ward to ward campaign in October last year, however, commended the state Commissioner of Police, Abiodun Alabi, for doing his best to arrest the ugly situation.

This was just as he said it was about time the state governor, Babajide Sanwo-Olu, allow residents to make their choice in a democratic manner.

He recalled that the first attack against his campaign team was in Badagry on October 23, the second day of his campaign to the area, saying it was followed by another one that took place in Agege, and followed by similar incident in Kosofe, where his deputy, Akindele was attacked and prevented from entering the fruit market by thugs, loyal to APC.

Others were also allegedly, prevented from gaining access to their shops as at the time of filling this report.

The PDP governorship candidate, who spoke on recent attack in Surulere area of the state, dissociated self from the crisis, against allegation by APC, saying that the ruling party was only trying “to turn things around to favour them.

“The next thing was in Surulere, the first day was okay for us.

“The second day I was in the mosque to pray, and as I stepped out of the mosque and I heard the attackers, they were asking where is Jandor, where is Jandor? They hijacked our vehicles and damaged them. The ruling party was only turning things around,” he said.

Jandor said 2023 was beyond him, but between the people of Lagos and the status quo, declaring that it was about time for residents to break the monopoly and elect with their Permanent Voter Cards, PVCs, a governor who is not answerable to the beck and calls of a godfather.

On the the governorship debate which was scheduled to hold on Sunday, boycotted by Governor Sanwo-Olu, Jandor said he was not surprised, saying: “What is your expectation of a governor who said he would not be seeking a re-election if he was not able to fix traffic gridlock in the state and a governor who met poverty rate at 4.2per cent but it’s now 8.5per cent?

Jandor said the excuse the governor gave which had to do with attacks and safety was not tenable as, according to him, it was him that was attacked and not the governor.

According to Jandor, “This speaks volume of Governor Sanwo-Olu as Chief Security Officer of the state as he cannot guarantee his own safety,”

He declared that he was prepared to feature at the debate which he said had been shifted for about four times in the past by Sanwo-Olu.

“It just worries me that the Chief Security Officer of a state is saying he is not safe, I am safe and I will go everywhere in Lagos.

“The debate wasn’t put together for me or Sanwo-Olu, it is for people of Lagos State. I will go, he has given me role of big brother to play. I will go because I want people of Lagos to listen to me and know what I want to offer. This 2023, they wouldn’t come again,” he added.

Also speaking, PDP Chairman in the state, Aivodji, condemned the incessant attacks on PDP members, saying similar incidents were happening in villages and hamlets across the state, stressing that PDP would not be intimidated.

He said the moment Jandor started his ward to ward campaign, the APC became jittery.

Lagos govt reacts

However, in an earlier statement by the Lagos State Commissioner for Information and Strategy, Gbenga Omotoso, spoke on the Surulere attack and the reason why Governor Sanwo-Olu’s boycott of the debate.

Will never condone violence

The statement by Omotoso read in part: “The Lagos State Government has noted the flood of comments sparked by the shocking video of a group of thugs shooting in broad daylight in Surulere.

“Security agencies are investigating the video, which has gone viral on the social media. We believe they will fish out and prosecute the evil actors, who are believed to be henchmen of the opposition PDP.

“We condemn this savagery that has portrayed our state, the safest in Nigeria, in a bad light. That is not who we are; we are civilized and cultured.

“Following advice from competent sources, including elders and respectable Lagosians, we will henceforth shun any forum that may require us being together with PDP and its agents of violence.

“Consequently, Governor Babajide Sanwo-Olu regrets to announce that he will not be participating at The Platform Governorship Debate of January 29, 2023.

“The Governor holds Pastor Poju Oyemade and the Covenant Christian Church family in high esteem and cherishes future opportunities to engage the congregation and render accounts of his stewardship to them as integral parts of the Lagos electorate.

“We will never be found in the company of those to whom the lives of innocent Lagosians mean nothing. Mr. Sanwo-Olu won’t share a podium with them.”

2023: Jandor vows to break Tinubu’s ‘monopoly’ if elected.

The 2023 governorship candidate of the Peoples Democratic Party (PDP) in Lagos State, Olajide Adediran, popularly known as Jandor has vowed to end what he described as the 24-year monopoly of a former governor of the state, Bola Tinubu.

“We will come in and do things differently. The problem of Lagos is that we have one head thinking for the state of Lagos for the past 24 years,” Jandor said on Channels Television’s Sunrise Daily programme on Thursday.

The PDP governorship candidate in Lagos also accused Tinubu, the 2023 presidential candidate of the All Progressives Congress (APC) of removing “performing governors” in the state.

Jandor said though former governor Babatunde Fashola survived an attempt to remove him in 2011 and returned for second term, his successor, Akinwunmi Ambode couldn’t survive a plot that saw him removed after a single term in 2019.

He promised to decentralise developments across the 20 local government areas of the state if elected in the forthcoming polls.

“In our very first year in office, we will do a whole lot across Lagos. We need to decentralise development. Everybody comes to the centre for greener pastures but if you give the development where they are, they will actually stay there.

“We will do a whole lot because we will be coming in as independent government; the one not tied to the apron string of anybody and that will allow us to make Lagos wealth that we only hear now work for Lagos,” he said.

Jandor lamented what he described as hegemony and monopoly of the state by Tinubu, who was Lagos governor after Nigeria’s return to democracy in 1999.

“The problem is this monopoly that we need to break. If we have a governor that is independent, we won’t have this problem and that is what we represent,” he said.

Jandor also slammed the incumbent governor, Babajide Sanwo-Olu over “failure” to allegedly utilise the resources of the state to improve the education, health and transport sectors.

“A government with these resources and the statistics still not speaking to the resources shows failure and the reason is not farfetched; there is a monopoly that we need to break and allow fresh ideas and new thinking. Until we do this, we will continue to have the same report and this cosmetic of people saying they are working,” he said.

In December 2021, Jandor, the leader of the Lagos4Lagos movement within the APC in Lagos dumped the ruling party with his followers and was received into the PDP by former Senate President, Bukola Saraki. He would later get the PDP governorship ticket in the state.

Where Is Ambode?
Since Nigeria’s return to democracy in 1999, Ambode is the only former governor of Lagos who was in office for a single term. Tinubu was governor between 1999 and 2007 before he handed over to Fashola, who is now the Minister of Works and Housing, was in office as governor from 2007 to 2015.

Ambode took over in 2015 but lost his re-election at the primary level in the 2019 electioneering process due to intra-party squabbles as APC strongman in Lagos (Tinubu) was reported to have favoured Sanwo-Olu.

Sanwo-Olu clinched the party’s ticket and won the 2019 governorship election and has again secured APC’s ticket for his re-election in the 2023 polls.

Since he ended his single term in 2019, Ambode has not been seen at political or social functions with his predecessors – Tinubu and Fashola. He has also not been seen at events with the incumbent governor.

The former governor has also been reticent at the few times he was pictured at APC events at the national level like in May 2021 when he was appointed the deputy chairman of the South-West sub-committee of the Contact and Strategy Committee of the ruling party.

There were reports that Ambode would contest the party’s governorship ticket with Sanwo-Olu at the primary in May 2022. Rather, his ally, Wale Oluwo, threw his hat in the ring but lost to Sanwo-Olu.

Unlike Fashola and Sanwo-Olu, Ambode has not publicly endorsed Tinubu’s 2023 presidential ambition and has not been seen at any political event linked with Tinubu’s aspiration for Aso Rock but the weeks ahead of the February 25 presidential poll are still much very pregnant

PDP claims assassination attempt on Jandor – blames APC.

The Campaign train of the Governorship Candidate of the Peoples Democratic Party – PDP in Lagos State, Dr. AbdulAzeez Olajide Adediran (JANDOR) was attacked on Sunday.

The incident occur around 6:30 pm, while they were returning from a visitation to members of the party at the Ikoga Junction area of Badagry Local Government by APC-sponsored thugs.

Several members of the entourage of JANDOR and pressmen were attacked and as at the time of this press statement, one of the journalists was in critical condition in an undisclosed hospital, while others are being treated.

“You will recall that our party raised concern over the threat to use sponsored thugs to attack the campaign programs of our Gubernatorial candidate Dr. Abdul-Azeez Olajide Adediran-JANDOR recently.

“We would like to state categorically that this will not deter the determination of our candidate to campaign for the next election and win the election come March 11, 2023.

“We hereby call on the Commissioner of Police, Lagos State and the Area Commander of Police in the Badagry Division to do everything possible to fish out those behind the attack and necessary disciplinary actions taken against them to forestall such occurrences in the future.

“This will instill confidence in our members that they will be protected during this campaign period,” the statement read.

We also warn “those that are hell-bent on causing trouble or planning to disrupt the campaign and elections that we would not fold our arms and watch as we will resist all forms of intimidation.”

Top Nollywood actress, Funke Akindele, has just gifted veteran actor, Kayode Olasehinde ‘Ajirebi’ aka Pa James with a brand new home.

Noble Reporters Media learnt that the kind gesture is coming after the house of veteran Nollywood actor, Ajirebi Kayode Olasehinde, located in Oke Isagun community of Oke Odo LGA in Lagos was destroyed by flooded after heavy rainfall.

The rain forced a canal to overflow thereby releasing its content into the property of the actor which has become a regular occurrence.

Announcing the kind gesture by Funke Akindele, actress Kemi Korede via Instagram wrote: “On behalf of PA JAMES, I Want to say Big thank you to @funkejenifaakindele for the new apartment given to him by you. God bless you so much for your good heart. your type is so rare..you are a gem. Almighty God will continue to make way for you where there seems to be no way.”

I was amazed at how noise on social media is capable of swaying the minds of seemingly reasonable people after hearing just one person’s account of a story. Social media is an amazing tool with infinite opportunity to impact lives positively and open up minds to endless possibilities, but today it is being weaponised, used to destroy people’s reputation and livelihood – ‘all this for a drop of clout?’.

Until you fall victim of this extremely illogical mob justice carried out on social media today, you won’t understand how senseless and horrible it is. How do you expend so much energy casting judgement on social media, just to appear morally sound off one-sided accounts? Ironic, isn’t it?

One of the first things I learnt was the importance of listening and analysing both sides of the story before having an opinion and making judgement. I thought that was basic knowledge for every adult, apparently not.

Life is hard, funds are scarce and the government keeps dropping policies that don’t favour the masses, and this in my opinion has to be the only logical reason why people are so bitter and angry, ready to lend their voice to the destruction of whoever happens to be their victim for that day. This crab in a barrel mentality needs to be checked.

Yes, everybody loves the classic US versus THEM scenario. We feel weak so the moment we’re presented with a David & Goliath story, everybody is eager to whip out their slingshot. It’s just sad that we believe we are wise, yet we still operate on the ‘person wey cry pass na him dey innocent’ level. Anyway, before I spend the entire day lamenting about the sorry mindset of my peers, let me share my experience working for Funke Akindele.

In 2017, I worked as her PR lead at Scene One Productions. It was a 9-5 job which also had me visiting her home more often than I expected. I was shocked at how she was almost nothing like her social media personality the moment work was involved.

Funke Akindele is one of the most focused, driven, and hardworking person you’ll ever meet! From non-stop rehearsals, writing and reviewing scripts, auditioning new actors and spending so much time on shoots with her co-stars, I realised why she is one of the most successful actors and businessperson in the Nigerian entertainment scene.

During my time shuffling between her office and her house, I saw exactly how she treated her office and domestic staff. The part of her you got was greatly dependent on your attitude to work. She is hands-on and very intimidating; if you were unsure of the role you had to play on her team or just incompetent, you definitely would hate her. One simply does not build an empire by joking around when it’s time to work.

Conversely, the way she treated those who did their job well, especially the cooks, cleaners and her entire domestic staff would leave you thinking she was their mother. She joked around with them, allowed freedom to express themselves and created an enabling environment, at the same time, she wouldn’t hesitate to scold anyone who misbehaved.

I read tweets of people talking about how mean and insensitive she was and all I could see from my experience with her was the fact that those people were most likely just lazy. Nigerian youths hate to be called lazy, but we are always looking for shortcuts and free meals, just look at how youths and even celebrities are defending fraudsters and justifying fraud on social media today.”

Popular Nollywood actress cum producer, Funke Akindele, also known as Jenifa in her infamous TV series “Jenifa’s diary”has taken to her Instagarm page to brag about being a hardworking woman and a perfectionist.

The mother of twins made this revelation in her Instagram story using a boomerang of herself working and hash tags .

This is coming after she was dragged online for allegedly being a physical, financial and mental abuser to her staff.

Recall with Noble Reporters Media that one of her former staff, Cassandra Owolabi took to social media to drag her for being an abuser and claimed her abuse pushed her into depression.

Gist+: Court picks date to hear suit questioning Funke Akindele’s arrest

The Federal High Court in Lagos will on July 10 hear the suit asking it to quash the conviction and sentencing of Nollywood actress, Funke Akindele; her husband, Abdul-Rasheed Bello; and 236 others arrested, pursuant to the Lagos State Infectious Diseases (Emergency Prevention) Regulations 2020.

Governor Babajide Sanwo-Olu had signed the prevention bill in March in response to the coronavirus pandemic.

Funke Akindele-Bello was arrested and sentenced by the Lagos state police command over the house party hosted in her house to celebrate her husband’s birthday on Saturday at their Amen Estate residence.

However, the plaintiff in the suit, Olukoya Ogungbeje, wants the court to declare that the law is inconsistent with provisions of Chapter IV of the 1999 Constitution relating to fundamental human rights.

Mr Ogungbeje told the court that he had a duty “to protect and defend the sanctity of the Constitution of the Federal Republic of Nigeria from any contravention or infraction.”

He urged the court to declare that “the purported arrest, arraignment, trial, conviction and sentencing of persons/Nigerian citizens under the Lagos State Infectious Diseases (Emergency Prevention) Regulations 2020 for an alleged offence unknown to law and violation of same, which cannot be grounds for criminal liability is a nullity.”

He also urged the court to hold that by virtue of the Court of Appeal’s pronouncement in the case of Faith Okafor vs Lagos State Govt. and ANOR on November 4, 2016, “a directive issued by a governor is not a law and violation of same cannot result in criminal liability.”

Justice Maureen Onyetenu adjourned to hear the suit on July 10.

Actress Funke Akindele has commented on the death of former beauty queen, Ibidun Ighodalo, wife of Pastor Ituah Ighodalo Pastor of Trinity House Church.

Actress Funke Akindele has refused to disclose how far she has gone with the community service duty she was sentenced to by a court in Lagos.

Funke Akindele bagged the sentence after she threw a party at her Ibeju Lekki residence with singer Naira Marley and over 50 people present.

The actress was arrested after a social media outcry over the likelihood of a spread of coronavirus due to the flouting of the restriction order in Lagos by the actress’s decision to throw a party with that much guests.

A Twitter user who is yet to forget about the whole incident decided to find out if she has completed the sentence she was given.

Don Jazzy has applauded actress Funke Akindele-Bello for owning up to her mistake after her faceoff with the Lagos state government.

Recall that the actress and her hubby, JJC Skillz, were arraigned before an Ogba Magistrate court by the state government for holding a house party in their Amen estate home on April 5 despite the social distancing order. Funke acknowledged her mistake and thereafter apologised to Nigerians.

Following Funke Akindele and her husband’s prosecution, Nigerian singer, Paul Okoye has expressed his bitterness at the way the case was judged at the court.

Recall with NobleReporters that Funke Akindele and her husband, JJC was taken to court on 7th of April, 2020 after being arrested for flouting the lockdown directive.


They were fined N100,000 naira each and sentenced to community service for 14 days.

Moments after the sentence, Paul Okoye in a live video stated that all police and journalists at the court room also flouted the same rule they were sentencing Funke Akindele and her husband for.

A Nigerian lawyer has explained why Funke Akindele and JJC Skillz’s conviction for violating a lockdown order issued by the Lagos state government, cannot stand in law.

Recall that we reported earlier that the couple were handed a fine of N100,000 each and also sentenced to 14 days community service, three hours per day excluding Saturday and Sunday.

Constitutional Lawyer, Inibehe Effiong who reacted to the development pointed out the flaws in the law which aided the conviction.

He wrote;

Why The Conviction Of Funke Akindele Cannot Stand In Law


INTRODUCTION:


The trial and conviction of actress Funke Akindele and her husband is legally flawed. The fact that they pleaded guilty does not foreclose a discussion on the case because the flaws that I intend to highlight are constitutional and jurisdictional in nature. Issues of jurisdiction can be raised at any time.

I have read the following: The Charge Sheet filed by the office of the Attorney General of Lagos State against Funke and her husband; the Public Health Law Cap. P16 Vol. 9 Laws of Lagos State, 2015; and the Lagos State Infectious Disease (Emergency Prevention) Regulations 2020.

I submit that Funke Akindele and her husband (the defendants) were convicted for a non-existent offence. The charge sheet shows that the two defendants were arraigned on a one count charge for gathering with more than twenty persons contrary “to the social distancing directives of Mr. Governor of Lagos State.”


DEFENDANTS CHARGED FOR AN OFFENCE THAT IS UNKNOWN TO LAW:


The charge sheet against the defendants also state that the said social distancing directive contravened by the defendants was issued by the Governor in line with the regulations made by the Governor pursuant to the Public Health Law. In other words, the defendants were not charged under the Quarantine Act.

They were charged under Section 58 of the Public Health Law of Lagos State. For clarity, Section 58 of the Public Health Law cited in the charge sheet provides as follows:

“For any contravention of the provisions of this Law or any Regulation made under this Law for which no other penalty is provided, the offender commits an offence and is liable on conviction to a fine of One Hundred Thousand Naira (N100,000.00) or to any non-custodial sentence and if a corporate body, to a fine of Five Hundred Thousand Naira (N500,000.00).”

The defendants were convicted for gathering with more than twenty persons. The material question is: is it an offence under the Public Health Law or Infectious Disease Regulations to do so? There is no provision under the Public Health Law or Infectious Disease Regulations that makes gathering with more than twenty persons a criminal offence.

The Infectious Disease Regulations purport to give the Governor the power to issue the social distancing directive. The legal defect in the directive on gathering is that it cannot be the basis for criminal liability. A subsidiary legislation like the Infectious Disease (Emergency Prevention) Regulations 2020 derives its authority and validity from a substantive law (the principal legislation). The regulations cannot extend such authority.

Since the Quarantine Act and the Public Health Law of Lagos State specifically limit offences to contravention of regulations made by the governor, it is outright illegality to charge Funke Akindele and her husband for contravening a directive of the Governor (which is outside the regulations itself). See Din V. Attorney-General of the Federation (1988) 4 NWLR (Pt.87) 147.

An act or omission is only a crime if it is so prescribed in a written law. By virtue of Section 36 (12) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), every person is guaranteed the fundamental right not to be convicted unless the offence is defined and the penalty is prescribed in a written law. It states as follows:

“Subject as otherwise provided by this Constitution, a person shall not be convicted of a criminal offence unless that offence is defined and the penalty therefor is prescribed in a written law, and in this subsection, a written law refers to an Act of the National Assembly or a Law of a State, any subsidiary legislation or instrument under the provisions of a law.”

Let me reiterate that the Governor’s social distancing directive that restrict gathering in Lagos State which the defendants purportedly contravened is not an Act of the National Assembly, or a Law of the Lagos State House of Assembly, neither is it a subsidiary legislation or an instrument under the provisions of the law.

Therefore, by the authority of Section 36 (12) of the Constitution, and the Supreme Court decision in Aoko V. Fagbemi & Ors. (1961) 1 All NLR 400, the conviction of Funke Akindele and her husband is unconstitutional.

As I contended earlier, there is no provision in the Public Health Law of Lagos State or the Infectious Disease Regulations that makes a gathering of more than twenty persons or any gathering for that matter a criminal offence.

Regulation 8(1)(a) of the Infectious Disease (Emergency Prevention) Regulations 2020 cited in the charge sheet against the defendants provides thus:

8(1) “The Governor may –

(a) restrict or prohibit the gathering of persons in the Local Area, such as conferences, meetings, festivals, private events, religious services, public visits, and such other events, save where the written approval of the Governor is obtained for such gathering.”

The above provision does not codify any offence. It only empowers the governor to restrict or prohibit gathering. The Infectious Disease Regulations 2020 should have expressly and specifically prescribed that gathering is restricted and prohibited in Lagos State before it can be relied upon to convict a violator in line with Section 36 (12) of the Constitution.

Since neither the Public Health Law of Lagos State nor the Infectious Disease Regulations has prescribed that gathering is an offence, the purported directive of Governor Sanwo-Olu remains an advisory.

The Court of Appeal in the case of Faith Okafar V. Governor of Lagos State & Anor. (2016) LPELR-41066 (CA) made it abundantly clear that the directive or order of a governor is not a law and that violation of same cannot result in criminal liability.


COMPETING REGULATIONS AND DOCTRINE OF COVERING THE FIELD:


The Infectious Disease Regulations was made by Governor Sanwo-Olu pursuant to Section 8 of the Quarantine Act Cap. Q2 LFN 2004 and the Public Health Law of Lagos State. However, Section 8 of the Quarantine Act only empowers the governor to make such regulations where the President fails to do so.

On 30th March, 2020, President Buhari issued the COVID-19 Regulations. In his regulations, the President made specific provisions restricting movement and imposing a lockdown in Lagos State. By the constitutional doctrine of covering the field, the regulations made by Governor Sanwo-Olu went into abeyance the moment the regulations made by President Buhari came into effect. Both cannot coexist.

The doctrine of covering the field was applied in the case of Attorney General of Ogun State V. Attorney General of the Federation (1982) 1-2 S.C. (Reprint) 7. where the Supreme Court per Fatayi-Williams, JSC, declared that the Public Order Act 1979 repealed all existing State laws on public order.


THE GOVERNOR HAS NO POWER TO MAKE REGULATIONS UNDER THE PUBLIC HEALTH LAW:


It should be further noted that under Section 53 of the Lagos State Public Health Law, the power to make regulations pursuant to that law is expressly vested in the Commissioner for Health; not in the governor. This raises more serious legal questions on the validity of the Infectious Disease Regulations issued by the governor.


REGULATIONS REQUIRES THE APPROVAL OF THE HOUSE OF ASSEMBLY.


Section 1 (1) of the Regulations Approval Law Chapter R4 Laws of Lagos State 2015 unequivocally provides as follows:

“Notwithstanding any provision to the contrary in any Law in the State, no regulation shall have effect unless laid before and approved by the House of Assembly.”

Section 3 of the Regulations Approval Law further mandate that “all regulations made pursuant to the provisions of any enactment in the State shall be published in the Official Gazette after its approval by the House of Assembly.”

The inescapable consequence of the above condition stipulated in Section 1 (1) of the Regulations Approval Law is that the Infectious Disease (Emergency Prevention) Regulations 2020 issued by Governor Sanwo-Olu to tackle coronavirus pandemic has not taken effect since it is yet to be laid before and approved by the Lagos State House of Assembly.

Since the charge against the defendants was brought under a regulation that has not been approved by the House of Assembly as required by law, the entire case – from the charge sheet, to arraignment, conviction and sentencing of Funke and her husband, is a nullity.

We cannot put something on nothing. This singular point is enough to nullify the conviction.


PUNISHMENT IMPOSED EXCEEDS THE LAW:


Apart from the above legal flaws, the punishment imposed on the defendants by the trial court is clearly overreaching and illegal. Section 58 of the Public Health Law of Lagos State under which Funke Akindele and her husband were convicted provides for only two forms of punishment. It provides as follows:

“For any contravention of the provisions of this Law or any Regulation made under this Law for which no other penalty is provided, the offender commits an offence and is liable on conviction to a fine of One Hundred Thousand Naira (N100,000.00) or to any non-custodial sentence and if a corporate body, to a fine of Five Hundred Thousand Naira (N500,000.00).”

The trial court sentenced Funke Akindele and her husband to 14 days community service each, to start from 9.00am to 12 noon each day during which they are to sensitize the public on the COVID-19 pandemic in ten major areas of the state. They are also to pay a fine of N100, 000 each after which they would observe the period for isolation.

The implication of the expression “OR” as used in Section 58 of the Public Health Law is that the court can either impose a fine or a non-custodial sentence; the trial court cannot impose both.

The 14 days community service cum public enlightenment and the self-isolation imposed on Funke Akindele and her husband can be regarded as a non-custodial sentence. It was wrong for the trial court to additionally impose a fine of One Hundred Thousand Naira (N100, 000.00) on each of the defendants.
